The Florida child relocation law requires a custodial parent who wants to move a child more than 50 miles notify the non-custodial parent of a proposed relocation by sending a Notice of Intent to Relocate.
Your Notice of Intent to Relocate must be sent to the other parent before you move. The Notice is a specific form and must include:
1. A description of the intended new residence – include the state, city, and specific physical address, if you already know it.
If the residential parent is entitled to a public records exemption of his or her address (police, foster parents and certain other public employees), the court has to order modification of the disclosure requirements of this section, so that confidentiality is maintained. One suggested way of handling this is to put the exempt information on a separate sheet of paper. On the Notice, say that the information is provided on a separate sheet and is exempt by Florida law. Provide the Notice and the extra sheet to the other parent, but only file the Notice.
2. The mailing address of the new residence, if not the same as the physical address, if you already know it.
3. The home telephone number of the new residence, if you already know it.
4. The date you intend to move.
5. A detailed statement of the specific reasons for the move. If one of the reasons is based upon a written job offer, the offer must be attached to the Notice.
6. A proposal for the revised schedule of visitation and for the new transportation arrangements. If you don’t include this part, the court can dismiss your request. If there is a current, valid order abating, terminating, or restricting visitation, failure to comply with this provision will not cause dismissal. That’s also true if you have another “good cause” reason before you want to move. In either of these cases, the judge will still want to know your plan for future visitation if it is ordered.
You can also change the child support to consider the increased transportation costs. If you want to do this, you need to explain exactly how you arrived at the new child support amount. The court needs to be sure that the children are adequately supported. Reducing the child support more than 5% from the amount in the guidelines has to be clearly explained.
7. This statement in capital letters:
AN OBJECTION TO THE PROPOSED RELOCATION MUST BE MADE IN WRITING, FILED WITH THE COURT, AND SERVED ON THE PARENT OR OTHER PERSON SEEKING TO RELOCATE WITHIN 30 DAYS AFTER SERVICE OF THIS NOTICE OF INTENT TO RELOCATE. IF YOU FAIL TO TIMELY OBJECT TO THE RELOCATION, THE RELOCATION WILL BE ALLOWED, UNLESS IT IS NOT IN THE BEST INTERESTS OF THE CHILD, WITHOUT FURTHER NOTICE AND WITHOUT A HEARING.
8. Your mailing address – where you will receive the objection, if one is filed.
9. A certificate of service showing how and when you gave the Notice to the non-custodial parent.
10. You must sign the Notice of Intent to Relocate under oath and under penalty of perjury and send a copy of it to the non-custodial parent in accordance with the certificate of service. If there is no pending case, you must send the Notice by certified mail, returned receipt and restricted delivery or have a process server or the Sheriff’s office personally serve the Notice on the other parent. The original is not filed with the clerk yet.
You have a duty to update the information you give in the Notice of Intent as it becomes known. So if you find an apartment in the new location, you need to provide that address as a Supplemental Notice. Remember you can send papers by mail after the first paper is served personally, so the Supplemental Notice can be sent by mail.
What if the Other Side Objects? The non-custodial parent then has 30 days to object to the relocation. If no objection is filed, you have to file a motion and ask the court to ratify the relocation. The motion has to be personally served on the other parent. Unless the other parent requests a hearing, the court will ratify the plan according to what is in your Notice of Intent to Relocate, including the visitation and transportation schedules and child support. No hearing is required.
If you receive an objection to the Notice, the parent who wants to move has to file a motion for permission to relocate and attach the Notice of Intent, including the certificate of service. The court will schedule a priority hearing.
At that hearing, you will have to show that, more likely than not, the relocation is in the best interest of the child. The judge will look at it from the child’s perspective, not the best interest of the parent. If the judge initially finds that the move is in the child’s best interest, the non-relocating parent then has a chance to prove that the relocation is not truly in the child’s best interest.
Can I Move in the Meantime? If you received an objection after giving Notice, you can’t move unless you get a temporary order allowing it.The court can enter a temporary order permitting the relocation if:
1. The required Notice of Intent to Relocate was provided on a time; and
2. The court finds preliminary evidence that there’s a likelihood the court will approve the relocation based on certain factors at the final hearing,
But, the court may not consider the temporary relocation as a factor in reaching its final decision. Before you ask for a temporary order, consider whether you want to move with the possibility than you may be ordered to return. Also consider whether you want to have two hearings before you ask for a Temporary Relocation Order.

How To Move Your Child Out Of Florida – New Florida Child Relocation Law
May 16th, 2012Do the Courts Still Automatically Give Custody of the Kids to the Mothers Over the Fathers?
May 12th, 2012
It used to be that most states would just simply give custody of the kids to the mother (especially is the kids were under the age of five). However, in most states this rule has been thrown out completely. If both parents appear to be fit to raise the child that’s when it can get tricky in the courts.
There is no law in any state that says a mother will get custody of the child in the event both parents seem fit. Today the courts look at the child’s best interest, regardless of the parent’s gender.
However, more often than not the divorcing couples decide that the mom will have custody after divorce and the dad will get visitation rights. This decision is made because in many cases the mother will have more time to spend with the kids since the father is usually working 8-10 hours a day.
Sadly, sometimes the father will not try and fight for custody because of the aforementioned stereotype. This is a shame for the kids and the father both. If the father would do a little research he’d find out that it’s not a woman’s court anymore and dad can get custody of his child just as easily has mom can.
Fathers should not be afraid to fight for custody of their children because of some foolish gender stereotype. After all, in most homes both parents work full time so the father has just as much a chance of winning custody as the mother does.
The judge is going to look at the child’s best interest. If you feel you are the better parent for your child then don’t be afraid to ask for full custody. This is the 21st Century, and the courts no longer give custody of the children to the mothers anymore. Fathers have an equal shot in the courts nowadays. But you’ll have to be prepared, so do some reading on the topic so you’ll be ready to win custody of your child.
Kids and Cyber Bullying
May 9th, 2012
Cyber bullying is a form of harassment where a minor is involved as a victim. Most of the time the bully is also a minor, but not always. Unfortunately, at the time of writing this article there is no law against cyber bullying. Even when an adult brought a victim to the edge so that she committed suicide, the lawyers argued that any action will be taken against the “murderer” will be a “crime against the freedom of speech”!
As bitter as it tastes, this is reality that we have to deal with. As parents, we are obligated and entitled to protect our kids the way that fits with our capabilities and situations. Below you’ll learn about some forms of cyber bullying, and what you can do to deal with such a situation where your kids are under virtual attack of an irresponsible person.
Cyber bullying can take several forms. Any act that hurts the feelings of your child can be classified as bullying. Those acts might include calling names in chat rooms or emails, posting mean comments on blogs or social media, all the way through videotaping the victim in humiliating positions and sharing the material with the world.
To deal with these situations you need a strategy, not just an immediate action. This strategy is suggested to be as follows:
First, be 100% sure that your kids will come to you whenever they have a problem, and that they are also 100% sure they’ll find a listening ear and a loving parent willing to share the emotions and help sooth them away. Not doing this is the main reason some kids lost their lives due to cyber bullying.
Second, make sure your kids know what to do when they are being bullied. Have it simplified for them in a 1,2,3 type of action plan. If you need help with this get the proper help immediately.
Third, be always alert for signs of depression, low self esteem, and changes in your kids achievement in the school.
Statistics on Kids Running Away From Home
May 8th, 2012
We’ve always heard of kids running away from home. If it were because of maltreatment I’d definitely understand however there are other cases where they just ran off.
The number of runaway teens seems to go rampant. In a background check done by Federal Bureau of Investigation’s National Crime Information Center (NCIC) last 2001 there are about 840,279 missing person entries for both juveniles and adults. Their report shows that that about 85 to 90 percent of the said number are juveniles.
If we are to search criminal records, there are approximately 725,000 cases where a child’s disappearance needed the help of law enforcement. Let’s face it that there are those who kidnap or take advantage of the child’s needs to survive. They become involved in using drugs, prostitution or pornography. For those who just want to break free from these illegal activities, once they have been used to their lives although sick of it, don’t believe that social service agencies can help them. There are about 50 percent of runaways who usually don’t believe at all.
In the background check service on children missing, it was said that there are about 1 to 1.5 million who ran away from home yearly. This statistics alone need to remind parents that detecting the reason on why kids do such action should be noted as soon as possible so as to meet the problem first before it gets worst. If there are no problems that seem to surface then it is best to check our child’s protection as well.
There have been many means that the government has implemented to help the parents deal with their child’s behavior and even if they did run away. To make background check not only on the child’s life in and out of the house is not the only thing concern. It is also best if the people around the child are checked too in the process.
How to Include Martial Arts Kids Games As Part of the Syllabus
May 4th, 2012
In the animal world play is how a lion cub learns to hunt whilst a baby chimp will pick up valuable life skills by playing with siblings. For humans this is often forgotten, certainly by adults. Children will play all day long given the chance, assuming computer games are off limits. Introducing a sense of play into drills for kids, martial arts training can be made more enjoyable. A very obvious method to enable this is to establish relevant martial arts kids games as part of a Kung fu, Judo or Karate syllabus.
If a child is having fun he/she will come back. However, too much unimaginative repetitious training and a child’s mind wanders, rendering the martial arts class in question, BORING. Bored kids will not last the distance and more likely than not will end up dropping out.
Of course, it is essential to ensure that while everyone is having fun, martial arts relevant learning occurs. This balance can be achieved by tinkering with the class format and using imagination, either your own or that of the students themselves.
Kids get a big kick out of being IN CHARGE even if only to choose a game. By vetting kids idea’s some great games can be invented or adapted to include important martial arts skills.
One that works very well for improving movement skills is a two-person version of the classic STUCK IN THE MUD. In accordance with regular rules, when caught a person has to be rescued by a friend/student sliding between their legs, but there are two catchers, i.e. two students are on rather than the standard one. This game is fast, furious and chaotic with plenty of dodging, feinting and fast footwork required, similar movement skills to those needed when confronted by more than one opponent.
Another example could replace shouting out Japanese names for punching combinations. Whereby, kids can be encouraged to ‘punch round the clock’; hooks are 9 and 3 o’clock, uppercuts 6 o’clock, straights 11 and 1. By varying the angle of punches kids can punch round the clock in different orders thereby creating their own combinations.
Further, they can be instructed to get into position to punch around the clock by following someone with pads and entering while covering, dodging/feinting or ducking their way into range for striking the pads. You can always include an exit as well, which involves getting away from the pad holder without being BOPPED. This little game contains many essential skills presented in a fun format that promotes learning.
Performance can be rated/marked to reinforce good performances. A clear explanation helps kids understand what needs to be improved. If this is done in a competitive environment other team members can encourage their mates to use all the skills specified.
Incorporating relevant martial arts kids games into your kung fu, judo or karate syllabus is easily achieved with imagination. The benefit is fun filled lessons with engaged kids learning as they play and ready to stick with the martial arts program.
Law of Attraction – Simplified
May 1st, 2012
People are using the law of attraction all of the time through out the day and do not even realize it. They think that it needs to be such a concentrated effort, yet everyone does it everyday just like we eat, breathe and walk. Your mind and body are involved with the “Law of Attraction” on an every day basis, without being told.
This is how people think that it needs to be done. You must find a comfortable place, keep the kids quite and have some alone time creating your future. You sit in the room struggling to form a picture in your mind, get frustrated, try a few more times, mind starts wondering to the laundry and what you are making for dinner. Wow – that was a chore! Try it again later in the week. More laundry and grocery shopping, this is a waste of time, forget about it, and go back to real life.
What you need to pay attention to is what are you thinking about while you are driving in the car, waiting for a doctor appointment, lying in bed trying to fall asleep. When you were a kid you would think about the new bike you wanted, where you would like to live when you grow up. Daydreaming about fun things, because you did not have any responsibilities that would side track your mind. Find the inner child in you – when you are driving to work or to pick up the kids, use this time more wisely. Do not spend this “zone out” time worrying about bills, or the car, or how bad you do not want to go to the grocery store. Then get frustrated when you get an unexpected bill because the car gets a flat tire, and the grocery clerk was rude!
Here is a simplified plan:
1) Realize that you have a lot of “zone out” time through out the day. Driving is a huge one, falling asleep, waiting for people or appointments.
2) Use this “zone out” time and replace it with “daydreaming”. This has a nice feel to it when ever anyone thinks about daydreaming it is a fun thing.
3) Daydreaming should consist of how you would love your life to be and what it would feel like to be living that life. Like being at a job you love, living in a different area of the city or country, getting a new car, going on a vacation. It can be anything that makes you feel GOOD!
4) The key to great daydreaming is we allow ourselves to get lost in the feeling of being at a certain place in our life, or the excitement of purchasing something we only “dream” about. This feeling is a big trigger for the “Law of Attraction”, in the same way that panic is because we consistently feel like we do not make enough money to cover the bills. I do not know about you but I am willing to gamble on the trip, simple because if that happens – I know that I had enough money to cover the bills!
5) If you do have worries come into your mind at this time, replace the worry with a scenario in your head of how you want it to be resolved. Only solutions are allowed in your “zone out” time.
6) Also very important, recognize and acknowledge what you have created in the past and in the future. If you need new tires and immediately catch yourself worrying that it is going to be way more than you can afford, shift your focus to daydreaming that you get to the tire store and there is a sale on affordable tires. Remember this is daydream time, so do not question if this is going to work, just lose yourself stress relief and the great feeling of the daydreaming itself. If the next thing you know you are at the store staring at the affordable tires – take a moment to acknowledge what a good job you did. This gives you more and more control over the “Law of Attraction” in your life each time you just take a small moment to be proud of how you solved a problem.
People spend way too much precious daydreaming time wasted on everyday issues that get handled whether you think about it while driving or not. Let’s face it dinner will still get made, laundry will still get done, and the car will still get fixed. So, if you replace this time with daydreaming, you will be a much happier person, you will notice that your mood will be lighter and you will begin to attract more positive things into your life. Moods are contagious, so your family and co-workers will thank you for this. Life will feel easier, because I am sure that in your daydreaming time life is more enjoyable, every day is not such a chore. Also, problems that do arise will be solved much quicker and will not feel as hard to conquer.
Most people have at least 5 times through out the day that they have wasted daydreaming time. We can learn something from all of those smiling kids that want to know, “Why can’t I go to space? They have the space shuttle don’t they?” If you think about it, someone has to go to space, purchase the vacation, or buy a new car, why not you? What do you have to lose! I have always loved the saying, “If I am going to be thinking anyway, I might as well think big!”
Using the Law of Attraction to Raise Confident Kids
April 24th, 2012
We have probably all heard something about using The Law of Attraction to manifest our perfect lifestyle in recent years and that’s all well and good for us grown ups but what if we could use it to raise confident kids with an innate sense of their limitless abilities to achieve their dreams? Some of us maybe a little skeptical about all this ‘mumbo jumbo’, maybe even disappointed after perceived failed attempts but we as adults have collected many limiting beliefs along the way and the subconscious is renowned for resisting change.
However, make no mistake, these laws are working for us constantly, the problem arises in how we use them.
Kids on the other hand are fresh from the press with no added cynicism or artificial flavourings! They have no preconceived ideas on how life should or could be, only a clean slate upon which we parents may scribble indiscriminately. We all know of confident, happy people for whom everything seems so easy to attain, for whom life is the proverbial bowl of cherries and they’re loving it. This is no coincidence, their parents raised them using the law of attraction, even though they probably didn’t call it that, the mindset and the process is one and the same. Wouldn’t it be amazing if all our kids knew how to achieve their dreams so effortlessly?
As parents, our goal is to raise confident kids who will in turn become confident and happy adults. We are constantly aware of the future and anxious about what it might hold for them. Will they have their dream job, loving relationships, nice homes, a comfortable life? Our main preoccupation is to provide them with the tools necessary to fulfill these desires. We do our best with what was given to us and other bits and pieces we have collected on the way but using the law of attraction is the key to ensuring our kids unlock their true potential and create the life of their dreams. We may even learn a thing or two from them or at least worry about them a little less.
Simple Kids Science Fair Project Idea
April 23rd, 2012
You can use Charles Law to show a physical change in an ordinary bar of Ivory soap.
Charles Law states that a gas based material has a constant pressure and if the temperature increases so will the gas and if a bar of soap is made of foam this should cause the foam to increase in size because it is made of cell based gas molecules and will also increase in size.
Let us look at this before we proceed.
Soap is a foam. Foam can be any material that has trapped gas inside of it, somewhat like tiny bubbles. You may not think of soap as a foam because it is solid and hard but foam can come in many forms and they can be solid, hard or soft and spongy. You probably think of whipped topping as a foam as well as foam you use to shave.
We are going to test increasing the temperature on a bar of Ivory soap to see if the gas inside of the foam will cause the soap to expand and cause a physical change.
Here is what we need.
1. A bar of Ivory Soap
2. A paper plate
3. Another bar of soap; not Ivory
Now unwrap the Ivory soap and place on the paper plate.
Microwave the soap and watch it closely while it is cooking to see what happens.
Your soap should finish cooking in 1 to 2 minutes. This all depends on the temperature of your microwave. If you cook it too long the soap will not get any bigger.
Let the soap cool off before removing it or touching it. You may want a parent to help you with this so no one gets burned.
After the soap is cool touch it and examine it. The soap it flaky and hard. It is still soap and you can wash your hands with some of the flakes.
Why does this work?
Well, when you cook the soap it makes it soft and you are boiling the water and gas that is whipped inside of the soap. When you boil water it evaporates and as it heats also expands. When water turns to gas it expands and this causes the soft portions of the soap to also expand and makes it now actually look like a foam.
When you cook the soap there is a physical change but no chemical change. It is still soap. This is also why Charles Law is shown because the volume of gas increase as the temperature increases. The microwaves from your oven excite the energy molecules in the soap and cause them to move very fast and when they do this they move away from each other as they bounce off each other.
If you try another brand of soap, you will probably find that it puffs some but basically melts because many other soaps do not contain the same amount of air. I do not recommend cooking another kind of soap as some have lots of perfumes that have strong odors when they are being cooked.
This is why a bar of Ivory soap will float compared to other brands of soap. It has more air whipped into its preparation and just like a kid with a float on their arms full of air that causes them to float in a swimming pool, a bar of Ivory soap will float because it has lots of air packed inside. Test another brand of soap to see if it will float. Now cut the Ivory soap in half and look at it. Do you see the little holes of air? Look at another bar of soap after cutting in half.
When doing this science project:
Stay at the microwave and do not leave it unattended. Do not put metal items in the microwave This will not hurt your microwave or the soap. You can still use the soap when done. You will notice an odor from the soap as it is cooking. This will make your microwave smell fresh and flowery for a few hours. Only use Ivory soap.
Cell Phone GPS Surveillance
April 22nd, 2012
Boyfriends are using it to stalk their girlfriends, employers are using it to track their employees and parents are using it to control their kids. But, is it legal? The cell phone GPS surveillance industry is exploding. In the next few years it is expected to be a 20 billion dollar a year industry.
For a relatively small fee you can contact a cell phone provider and turn a portable phone into a surveillance and tracking device. But in most countries surveillance of an individual without their explicit consent is against the law. Whether it be monitoring whom you call, the contents of the conversation or your location it is a violation of privacy laws in just about all civilized countries around the world. You either need a law court’s permission or that person’s documented consent to use a cell phone GPS surveillance device to monitor them. Unfortunately the new technology is being used illegally far to often.
A terrifying example of abuse of cell phone GPS surveillance occurred recently in Oregon in the USA. A wife divorced her husband because he was trying to control everything she did. This type of situation is not unusual. Often the ex-husband will continue to stalk and try to control his ex-wife long after the divorce. In this case everywhere she went he would follow. There was nothing she could do to shake him off night or day. She was justifiably afraid he would kill her. If you look through the history of murders this situation often ends up being the motive. An excessively controlling man feels that he is losing his wife or ex-wife and in a fit of rage murders her as the ultimate act of control. She complained to the police but there was not much they could do. After several months of this going on the police checked her vehicle and found a cell phone behind the dashboard. The ex-husband had purchased a cell phone with GPS surveillance, hooked it up so that it’s battery was charged by the car’s battery and set the cell phone to silent answer. At any time he could call the cell phone and unless she was out for a long walk he would know exactly where she was and could even listen in on conversations going on in the car.
Unfortunately, your own cell phone can be used against you in a similar fashion if you are not careful. All it takes is for someone else to get a hold of your portable phone for about 5 minutes without you knowing about it. They can go on the Internet, register your phone with a cell phone GPS surveillance service and pay for it with their own credit card. All of this can happen without you knowing about it. The service will send several messages to your phone right away notifying you that you are being tracked but if the person erases those messages you will never know they set up GPS surveillance on you.
This GPS surveillance technology is not just for cell phones. It is showing up in a variety of portable electronic devices. It appears that watches will be the next big item to integrate GPS surveillance and tracking. Even today you can buy any of a dozen or more Timex watches that have integrated GPS tracking and surveillance. But along with this incredible micro technology goes a huge legal problem. Currently the software for these GPS surveillance devices does not contain significant safeguards against legal and privacy abuses but hopefully that will change before things get out of control.
Helping Kids Understand Sir Isaac Newton’s Three Laws of Motion
April 13th, 2012
Your son or daughter has science questions about Sir Isaac Newton’s three laws of motion. How can you begin to guide your child’s understanding of these concepts? Without thinking about them, we use Sir Isaac Newton’s three laws of motion every day. Newton’s first law explains why it is harder to stop a moving car than a roller skate. Newton’s second law algebraically relates the force on an object, its mass, and its acceleration. Newton’s third law concerns how forces act upon objects. By relating every day experiences, you can help your child understand Sir Isaac Newton’s three laws of motion.
1. Newton’s first law of motion is also known as the law of inertia. The term, inertia, derives from the Greek, inert, or not moving. Newton’s first law states that any object will remain stationary or will continue to move in a straight line unless it is acted upon by an external, unbalanced force. A force is a push or pull on an object. Inertia is a measure of the mass of an object. An automobile has more inertia than a roller skate. While you are traveling in a moving car, you are moving in the same direction and with the same speed as the car.
If the car suddenly comes to a stop, you will still be moving in the original direction, through the windshield if you do not use a seatbelt or airbag. The seatbelt keeps you in one position relative to the car’s motion, keeping your body against the seat. Inertia also explains why you lean towards the opposite direction as the car moves around a steep curve. If the car turns right, you lean towards the left; if the car turns left, you lean towards the right. Again, your body continues to move in a straight line during the turn, as it did before the turn.
2. Any time you want to change the speed or direction of an object, you need to use the appropriate force. Newton’s second law of motion relates the concepts of mass, force, and acceleration. In science, acceleration is the change in speed or direction of a moving object. Force on an object is equal to its mass multiplied by its acceleration. The strength of the force on an object depends upon the object’s mass, or how much material it contains, and how fast its speed is changing, or its acceleration.
An automobile hitting a wall at the same speed as a roller skate would have more force, since the car has more mass. A unit of measurement for force is the Newton, abbreviated N, named after Sir Isaac Newton. One Newton, or one N, is the force needed to move a mass of one kilogram one meter per second in a second. Or algebraically, 1 N = 1 kg * m/ s2. A Newton of force is a small amount. A person weighing 110 pounds exerts a force of 50 Newtons on Earth.
3. Newton’s third law of motion is more commonly called action reaction. For every action in one direction, there is an equal and opposite reaction in the opposite direction; even if the object does not move. Forces always act in pairs, even if the object remains still. While sitting in a chair, you provide a force on the chair acting down towards the floor. At the same time, the chair provides an equal and opposite upward force on you. If this were not the case, you would be sitting upon the floor instead. While you walk, for each step that you take your foot pushes against the floor. As you push, or provide a force, against the floor, the floor also pushes against your foot, propelling you forward. If you try to walk across sheer ice, you must adjust your steps, since the ice does not provide the same force as the floor.
By using every day examples, you can help your children understand Sir Isaac Newton’s three laws of motion. The law of inertia, or Newton’s first law of motion, describes how a stationary object begins to move or how the motion of an object changes. Newton’s second law of motion algebraically relates an object’s mass and acceleration to the amount of force involved to cause motion. Finally, Newton’s third law of motion involves the fact that forces on an object always act in opposing pairs, whether or not the forces cause motion.
